Custom Product Terms and Conditions

​

Installation: An estimated installation time frame will be provided. Once draperies are completed and inspected, an installation date and time will be scheduled. While we work diligently to ensure timely completion, unforeseen delays—including those related to COVID-19—may occur. Any delays will be communicated to you promptly.

 

Your custom window treatments will be installed by our expert installers using hardware in accordance with manufacturer recommendations. Draperies will be dressed as required. All valuables or furnishings (art, furniture, accents, etc.) must be moved out of the installation area prior to our arrival. If you prefer that Custom Drapes assist in moving these items, an additional fee may apply. We are not responsible for damage to items that remain in the workspace during installation.

Our designers and installers are trained to measure and install each product for the best possible fit. Custom Drapes guarantees the fit of our products when measured and installed by a Custom Drapes designer and installer. Note: Sheetrock around windows is rarely square which may result in visible gaps or the appearance that treatments are uneven—especially with inside mount applications.

​

On a case by case basis, our expert drapery installers may accommodate installation of draperies or hardware not provided by or produced by Custom Drapes. However, we cannot guarantee the fit or quality of materials not sourced through us. A $150.00 return trip fee will apply if an installation cannot be completed due to missing, broken, or unusable hardware or product not provided by Custom Drapes.

Photos & Publicity: Custom Drapes may document your project (including photography and video) for use in our portfolio and marketing efforts, including on social media and in press/publications. We will never disclose your name or address without your consent. All marketing-related costs are the responsibility of Custom Drapes. If you or your team publish any documentation of the project, Custom Drapes must be credited.

Permits: You are responsible for obtaining any required permits or approvals from applicable authorities.

 

Changes: Customers must disclose to Custom Drapes any architectural changes or additions, such as blinds and shutters, cabinetry, beams, shelving, crown moldings, etc. prior to production. Changes to active orders may incur additional charges and must be agreed upon in writing.

Textiles: Fabrics characteristics such as stretching, stiffness, hiking, flaring, dye lot variation and imperfections are natural and not considered defects. Fabric dye lots may vary, and slight differences in color and texture between samples and the final product are normal. No fabric is completely stable and there should be tolerance for small fluctuations in drapery and shade lengths. Fabric colors and textures viewed online or in photos may not accurately represent the actual material due to differences in screen settings, lighting, and photography. Some drapery fabrics (due to yarn contents, construction, humidity, etc.) will expand or contract under certain atmospheric conditions. Fabrics may change in appearance when sun light is directed from the back side of the fabric. Please consult with your fabric sales person before purchasing customer’s own (COM) fabrics. Linings are highly recommended to reduce fading, but no fabric is guaranteed fade-proof. Seams will be matched where necessary but may remain visible.

Soil and Stain Finish: This treatment is optional and involves spraying the fabric to repel oil, water, and dirt. This finish is durable to steam cleaning and shampoo cleaning. The chemical properties of any textile finish have different effects on the various types of fabrics and dyes. While effective, no fabric treatment is 100% stainproof

 

Motorization: All motors and electrical components are sourced by third party vendors. Custom Drapes honors only the original manufacturer’s warranty on these items.

​

Wiring: Custom Drapes may provide customers with new electrical outlet location recommendations. The recommendations Custom Drapes supplies should be verified by a state licensed electrical contractor selected by customer and at the customer’s expense. Customer will be responsible for ensuring that the selected electrical contractor is licensed. Custom Drapes is not a licensed electrical contractor and is only providing electrical outlet location recommendations. Custom Drapes is not responsible for any wiring errors and/or errors performed by customer’s electrical contractor, including the positioning of the junction boxes or connections to the motor which may cause damage to the home or motors.

Maintenance: As part of the installation process, our installer and/or designer will dress your treatment(s) to ensure it falls into its intended pleats or optimal position. Depending on the fabric, we may tie up drapery to help train it to maintain its shape. Fabric properties vary, with some materials holding their form easily while others require additional time and occasional re-dressing to retain their intended appearance. Regular dressing may be necessary with use to preserve the drapery’s tailored look and ensure long-term performance.

Tariff Surcharges & Rate Volatility Notice: Due to continued fluctuations in international trade policies, tariff rates are subject to change at any time based on government regulation and international trade agreements. If tariffs increase between the time your order is placed and when your goods are shipped, any additional fees imposed will be added to your final invoice. While Custom Drapes LLC is unable to absorb unexpected tariff increases, we are equally committed to passing along any savings that result from reductions. Any applicable tariffs will be reflected in the final invoice.

COM (Customer’s Own Material): We accept COM fabrics on a case-by-case basis. A COM fee may apply for any fabric not supplied by Custom Drapes LLC. If applicable, this fee will be listed in your initial estimate. Clients or designers supplying fabric must ensure it meets all requirements and is suitable for the intended application. If tariffs apply to imported goods, these are the responsibility of the sender. Custom Drapes will not pay or accept responsibility for tariffs or duties. Applicable tariffs will be reflected in the final invoice.

Scaffolding & Equipment: If your project requires scaffolding or custom installation equipment, we will inform you in advance. Custom Drapes will provide the necessary equipment unless otherwise arranged.

 

Non-Disclosure Agreements (NDAs): If an NDA is required, we are happy to sign it. Please provide the appropriate documentation.

Warranty: Custom Drapes’ custom fabric treatments are guaranteed to be free from fabrication defects provided the product is correctly installed and used. This warranty is limited to the repair of Custom Drapes’ manufactured products. Custom Drapes maintains the right to determine whether the defect is covered by the warranty and how the fabrication defect will be corrected. Repairs will only be made to meet original specifications of the contract. If client discovers any fabrication defects concerning Custom Drapes’ products, please contact Custom Drapes within thirty days from the date of product installation. Defects must be reported within 30 days of installation. After 30 days, repairs for fabrication defects are not covered and Custom Drapes will not be responsible for the repair and will not be liable for any further damage to the customers’ window treatment(s) in question. Custom Drapes will make every effort to repair and reinstall the warranted product in a timely fashion.

 

LIMITS TO THE WARRANTY: This warranty is not transferable. This warranty does not cover damage from conditions caused by normal wear and tear; exposure to the elements (sun damage, wind, water/moisture, salt air) and discoloration or fading over time; misuse or abuse; abrasions or tearing from improper use or maintenance; damage from improper or neglectful maintenance or cleaning; improper self-installation; or costs associated with replacement of the fabric/treatment should the customer not be satisfied with their contracted window treatments and/or fabric selection, including labor, installation or shipping. Self-installation, installation on treatments and hardware not provided by Custom Drapes or installation not coordinated by Custom Drapes may result in damage to the fabric or hardware system, and shall void all warranties.

Cancellation Policy: Custom made products are not subject to cancellation or returns. Custom products cannot be canceled or returned once the order has been placed whether in stock or on back order unless otherwise agreed upon. All deposits are nonrefundable.

 

Payments: A 50% nonrefundable deposit is required to begin production. Accepted payment methods include credit card, check, cash, Zelle, Venmo or ACH. A 3.5% convenience fee applies to all credit card payments. We do not add any additional fees for card payments beyond what it charged to us by the bank. Any fees associated with your payment method are your responsibility. Once your deposit clears, we will begin your order.

 

All products remain the property of Custom Drapes LLC until paid for in full. Final payment is due upon installation. A $25 per day late fee will apply if the balance is not paid within 10 days of installation. Returned checks will incur a $25 fee. If legal action becomes necessary to collect unpaid invoices, the prevailing party is entitled to reasonable attorney fees and court costs.
